Terms of Use

These Terms of Use (“Terms”) form a binding agreement between you and PhoneKingz (“PhoneKingz,” “we,” “us”) governing your access to and use of phonekingz.com, our storefront, customer portal, influencer portal, batch drop events and all related services (the “Services”).

By browsing the Services, creating an account or placing an order you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Services. You must be at least eighteen years old, or the age of majority where you live, and able to form a binding contract.

Some features require an account. You agree to provide accurate, current and complete information and to keep it updated. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

We may suspend or terminate an account that we reasonably believe has been used for fraud, code abuse, reselling in violation of these Terms, harassment of our staff, or any other breach of these Terms.

PhoneKingz sells pre-owned and refurbished devices. Every device passes a documented inspection covering functionality, battery health, display integrity, cameras, connectivity, audio and cosmetic condition. Devices are assigned a condition grade, and the grade shown on the product page describes cosmetic appearance only; all graded devices are fully functional unless expressly listed otherwise.

Refurbished devices may show light signs of prior use. Photography is representative of the model and grade and may not be the exact unit shipped unless the listing states otherwise. Battery health figures are the minimum guaranteed at the time of shipment; batteries are consumables and degrade with use.

Devices are sold unlocked unless a listing states a carrier lock. It is your responsibility to confirm compatibility with your carrier and network bands before purchasing. Accessories included with a device are listed on the product page; original packaging is not included unless stated.

We work to keep listings, pricing and inventory accurate, but errors occur. We reserve the right to correct errors, change prices and specifications, and cancel or refuse any order, including orders that appear to be placed by resellers, bots or automated agents, or that resulted from a pricing error. If we cancel a paid order we will refund it in full.

All prices are shown in United States dollars unless stated otherwise and exclude applicable taxes, duties and shipping unless indicated. Your order is an offer to buy; a contract is formed only when we accept the order and ship it.

Checkout and payment processing are handled by Shopify and its payment partners. By submitting payment details you represent that you are authorized to use the payment method. Taxes are calculated at checkout based on your shipping destination.

We may limit quantities per customer, per household or per order, particularly during batch drops and promotional events.

Batch drops are limited-quantity releases that go live at a published date and time. Availability is first come, first served, and stock is not reserved by adding an item to your cart. Countdown timers are provided for convenience; the authoritative drop window is the one recorded in our systems.

Gift codes and promotional codes are issued for personal, non-transferable use. Unless a code's terms state otherwise, codes cannot be combined, have no cash value, may be restricted to specific products or drops, may be limited to a set number of redemptions or one use per customer, and expire on the date shown. We may void codes and cancel related orders where a code was obtained or used through fraud, bulk automation, unauthorized publication on coupon aggregators, or any other abuse.

Influencer codes are tied to a specific partner and are subject to the same rules. Participation in a live drop through a social platform is also subject to that platform's rules, which we do not control.

Estimated dispatch and delivery windows are estimates only and are not guaranteed. Title and risk of loss pass to you on delivery to the carrier, except where applicable consumer law provides otherwise. If a package is confirmed delivered but not received, contact us within seven days so we can open a carrier investigation.

You are responsible for providing an accurate, deliverable address. Reshipment of packages returned as undeliverable due to an incorrect address may incur an additional shipping charge.

Devices are covered by a twelve-month limited warranty from the delivery date against hardware failure arising from normal use, unless a different term is stated on the product page. Accessories carry a ninety-day limited warranty.

The warranty does not cover accidental damage, liquid damage, cracked screens or housings caused after delivery, damage from unauthorized repair or disassembly, software modification or jailbreaking, normal battery wear below the guaranteed threshold, cosmetic wear, loss or theft, or devices reported lost, stolen or blacklisted after delivery.

Our sole obligation under the warranty, at our option, is to repair the device, replace it with a device of equal or comparable specification and grade, or refund the purchase price. Warranty service requires proof of purchase and use of our returns portal.

Except for this limited warranty and any rights you have that cannot be excluded by law, the Services and products are provided “as is” and “as available,” and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Returns are governed by our Refund and Return Policy, which is incorporated into these Terms by reference. Please read it before submitting a return request through the returns portal.

You agree not to use the Services to break any law; to scrape, crawl, harvest or index our content without written permission; to use bots, scripts or automated purchasing tools; to interfere with or attempt to gain unauthorized access to our systems, accounts, admin portal or asset repository; to reverse engineer any part of the Services; to impersonate any person or misrepresent an affiliation; to upload malware or harmful code; or to post content that is unlawful, defamatory, obscene, hateful or infringing.

Password-protected areas of the Services, including the brand asset repository, the influencer portal and the KingzNet administrative portal, are restricted. Do not attempt to access them without authorization and do not share access credentials.

All content on the Services, including the PhoneKingz name and logos, product photography, brand characters, illustrations, copy, layout, code and the brand toolkit, is owned by PhoneKingz or its licensors and is protected by copyright, trademark and other intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to view the Services for personal, non-commercial use. Brand assets made available to approved partners through the repository may be used only in accordance with the license and usage rules that accompany them. All other rights are reserved.

Third-party device brands and model names are the trademarks of their respective owners. PhoneKingz is not affiliated with, endorsed by or sponsored by any device manufacturer.

If you submit reviews, photos, messages or other content to us, you retain ownership but grant PhoneKingz a worldwide, royalty-free, sublicensable license to host, reproduce, adapt and display that content in connection with the Services and our marketing. You represent that you have the rights to grant this license and that the content does not infringe the rights of others.

Feedback and suggestions you send us may be used without obligation or compensation.

To the maximum extent permitted by law, PhoneKingz and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or the cost of substitute goods, arising out of or relating to the Services or any product, whether based in contract, tort, strict liability or otherwise, even if advised of the possibility of such damages.

Our total aggregate liability for any claim relating to a product or the Services will not exceed the greater of the amount you paid for the product giving rise to the claim or one hundred United States dollars.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability for fraud, personal injury or death caused by negligence, or any other liability that cannot lawfully be limited.

You agree to indemnify and hold harmless PhoneKingz and its affiliates from any claims, damages, liabilities, costs and expenses, including reasonable attorneys' fees, arising out of your misuse of the Services, your violation of these Terms, or your violation of the rights of any third party.

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before filing a claim, you agree to contact support@phonekingz.com and attempt in good faith to resolve the dispute informally for at least thirty days. If the dispute is not resolved, it will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, except that either party may bring an individual claim in small claims court. You and PhoneKingz waive any right to a jury trial and to participate in a class or representative action. Where arbitration is unenforceable, disputes will be heard exclusively in the state or federal courts located in Georgia.

You may opt out of arbitration by emailing support@phonekingz.com with the subject “Arbitration Opt-Out” within thirty days of first accepting these Terms.

We may modify, suspend or discontinue any part of the Services at any time. We may update these Terms; when we do we will change the effective date, and material changes will be announced on the site. Continued use after an update constitutes acceptance.

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets. These Terms, together with the Privacy Policy and the Refund and Return Policy, are the entire agreement between you and PhoneKingz regarding the Services.
